These conditions of travel amend the regulations of the tourist travel law and are agreed in addition between the traveller and the tour operator.
Subject matter of the contract
Boreal Tours Ky organises and arranges tours in
northern Scandinavia. Boreal Tours Ky commits itself to carry out the tours according
to description. The tours are offered either by Boreal Tours Ky or in cooperation
with a third party.
Registration / confirmation
The registration for a tour is binding if it arrived by mail, Internet or
phone. Fringe benefits and special requests are only valid if they are confirmed
by letter on the part of the tour operator. Registration represents a binding
contract for the traveller. The confirmation / invoice makes the contract
firm and legally valid for the tour operator.
Terms of payment
On receipt of the confirmation / invoice a part payment of 30% of the travelling
expenses is due. The remaining 70% are to be paid at the latest 3 weeks before
arrival. There is made an invoice over the total amount only. The travel documents
are delivered to the traveller 3 weeks before departure. The amount remaining
has to be transferred at the latest 2 weeks before the day of departure. In
case of a registration later than 3 weeks before departure full travelling
expenses have to be transferred immediately. Fringe benefits on the spot have
to be paid in advance or cash. Payment by credit card or cheque is not possible.
Withdrawal from the contract of the client
A withdrawal from a contract has to be done by letter only. In case of a withdrawal
up to 45 days before departure the full amount is refunded. 45 to 30 days
before departure 75% of the full amount are refunded. 30 to 21 days before
departure 50% of the full amount are refunded. 21 to 5 days before departure
25% of the full amount are refunded. There is no refund in case of a withdrawal
less than 5 days before departure, as well as non-appearance at the day of
departure. If the traveller misses the start of the journey or a connection
or if his onward journey is hindered by incomplete travel documents, this
is treated as a withdrawal from the contract. In case of an early breaking
off of a journey the amount for the benefits cannot be refunded to the guest.
In case of an illness or dead n the family the same conditions are valuable. The traveller
is free to send a substitute. But we recommend to take out travel cancellation
insurance.
Withdrawal form the contract of the tour operator
If the payment of the traveller does not arrive completely in due time and
also the reminder is not paid the tour operator can withdraw from the travel
contract. If the necessary minimum number of participants is not reached (see
description of the tour), the prevailing tour may (but does not have to) be
cancelled by the tour operator. There is also a right of withdrawal if a journey
is made more difficult, endangered or prejudiced by not foreseeable force
majeure. In these cases the tour operator will inform the travellers as soon
as apparent, yet at the latest 2 weeks before the start of the tour. Paid
travelling expenses are refunded in full. Further claims against the tour
operator do not arise.
Benefits
The scale of the accomplishments on the part of the tour operator results
from the description of the tour found in the Internet or brochure. Changes
are possible as long as they do not change the overall picture of the booked
tour. Price changes and changes of the date which result from economic conditions
as there are increase of transport costs and of service costs are also excepted.
In case of changes of the date or price changes the tour operator informs
the traveller immediately. If the change of the programme leads to an increase
in prices the traveller has the following rights: a) to accept a modification
of the contract b) to withdraw from the contract by letter within 5 days after
the receipt of the notification of the operator and the travelling expenses
are refunded in full amount.
Liability
The tour operator’s contractual liability for damage which is not bodily
harm is restricted to the full travelling expenses. The operator is liable
within the context of duty of care for the conscientious preparation, the
careful choice of the chief performer and for the accuracy of the performance
description in the Internet and brochure. The operator is not liable for damage
that emerged by force majeure, a third party or if the claimant himself is
at fault or because the instructions of the guide were not complied with.
Boreal Tours Ky accepts liability for direct damage due to death, bodily harm
or illness during the tour only when it is possible to prove liability to
Boreal Tours Ky. Boreal Tours Ky does not accept liability if a tour, a part
of a tour or a benefit that has been arranged by Boreal Tours Ky is concerned.
Because adventure tours and wilderness tours despite best preparation cannot
grant the same security as a package holiday tour, liability standard adapts
to these conditions. The traveller should be aware that he takes responsibility
for the participation in such a tour.
Guarantee– remedy and duty to cooperate
If the travel is not performed according to contract the traveller can ask
for remedy. For that purpose his cooperation is required – regardless
of our priority obligation to perform a contract. Therefore the traveller
is obliged to do everything reasonable for him to contribute to a repair of
the fault and to keep possible emerging damage as low as possible or to avoid
it completely. The traveller is obliged to report his complaints to the guide
on the spot. Otherwise there is no right to complaints.
Instructions about passport, visa and health
The traveller is responsible for the compliance with all the instructions
important to the realization of a tour. In addition to the usual travel documents
a tourist visa is required for tours to Russia. The traveller informs himself
in good time about the details of visa application before the start of the
tour.
Agent / tour operator
For some tours of other tour operators Boreal Tours Ky only appears as an agent. Despite the conscientious choice of operators Boreal
Tours Ky does not accept liability for the part of the realization of the
arranged tours.

- valid identity card or rather passport and if necessary visa

Insurance
We recommend to provide for adequate insunrance cover. Booked and paid travelling
expenses (including part payment) are secured by an insolvency insurance.
Place of jurisdiction
The place of jurisdiction of Taivalkoski (Pudjasjärvi/Oulu) is agreed
exclusively for lawsuits against Boreal Tours Ky.
